Summary:
Today, 6 September 2018, there was a hearing date to allow Nithyananda's legal counsel to argue against allowing the forensic evidence, specifically the sleaze video, to be submitted as evidence. Sorry to say that none of Nithyananda's big-shot attorneys* showed up to the court. Nithyananda and the other accused (not counting Gopal Reddy Sheelum, a.k.a. Bhaktanadna, A-2, for he is already separated from the rest of the trial because he went AWOL last June) bother to show up either. The Judge had no choice but to issue non-bailable arrest warrants to Swami Nithyananda (A-1) and Siva Vallabhaneni, a.k.a. Sri Sachitananda (A-3). Gopal Reddy Sheelum already has a non-bailable warrant out for his head. The judge allowed Sri and Ma Sadhananda (A-4 and A-6) a break because they normally show up. The Judge also allowed Ragani Vallabhaneni, Ma Sachitananda (A-5) a break due to her serious illness of cancer. So, now the holy threesome (A1 thru 3) are all prison bound before the main trial begins if they get caught.* It is our understanding that one local attorney did show up on behalf of Nithyananda. He wasn't prepared to argue and just informed the judge that the other high-profile attorneys including CV Nagesh and Paramila (Ranjitha's attorney) were too busy doing something else.

Sex Swami Nithyananda Hones in on his Disappearing Siddhis. Court Sees Differently. Absconding!
Hi there, Sri Nithyananda, where have you been? The CID police and the judge were looking all over for you today. Geez, you, Oh Great One, should have been there. At the very least, you, Salamander Nithyananda, should have brought your very own Hollywood Wax Museum piece, you know, the one that you put in center stage and have all your fawning sycophants worship when you are not there, which has been every day for almost three months. Yeah, that statue is totally creepy, but captures the essence of you. What irony. Hey, Nastyananda, do the eyes move in that statue like a grade 'B' horror movie? Just asking. OK, if that statue was too heavy for your muscle flexing yoga thugs to haul into the court, at least they should have brought in one of those cut-out cardboard pieces and told the judge that you're busy exploring the second dimension. And, as soon as one of your pretty room service ladies, ah, pumps you up and blows some life back into you, you'll be ready to proceed with the hearing. Or at least they could have said that you were run over by a steamroller and that you needed to take some of your so-called ayurvedic Viagra to pop up again. Who knows? They might have bought it.
But, now, Sri Nithyananda, your absense upset the judge, and he has cancelled your bail and issued a non-bailable arrest warrant out for you. All because you didn't show up. Tsk. Tsk.
And where were all your well-paid, well-dressed, and well-fed attorneys? Well, Well. There goes your wealth. They didn't bother to show up either. Was that like that hippie philosophy of 'what if they have a war and no one showed up'? Where were they? Were they too busy watching reruns of 'Dallas'? Did you not pay them? You oh knowing avatar of every known deity on the planet, couldn't have run out of cash, could you? We know that it's been almost three months since you last held one of your money-making programs where you separate 15 grand out dumb-as-paint dolts who've been lured in by the promise of learning grade 'B' magic tricks and passing those off as spirituality. A fool and his money are soon parted. But, you, Mr. Nithyananda, are no fool. No siree. How much money do you have squirreled away? And, what's the going currency in big house? Even the counsel for the accused No.1 has undertaken to keep A1 present before the court.
However, once again today also EP is filed on behalf of A1. Since there is directions from Hon'ble Supreme Court of India, it is for the accused to co-operate with the court for the disposal of the matter expeditiously.

The undertaking given to this court on 16.08.2018 has not been complied. On the last date of hearing Sri.ERGN for A1 has prayed time to argue on the applications filed under sec.301(2) of Cr.PC by CW1 and CW3. Not surprisingly, Nithyananda's ashram is still a 'beehive' of 'busy' termites that are looking for a way to gnaw out of their predicament. It would appear that Nithyananda 'remotely' initiated most of them as sannyasi on Guru Poornima as a way to entrenched his grip on them and trap them all into staying even if Nithyananda is no where to be seen.
You can check out their morning satsung on Facebook where they prance around like a cheap Busby Berkeley knockoff doing orchestrated and worthless things to look busy. Nithyananda's 'direct' message is to continue watching these worthless events.
After their 'hectic' morning, which usually contains some lame magic trick, the type of routine that magicians that are hired for kids' birthday parties would be embarrassed to preform, the busy, busy, busy ashramites go about their routine of harassing people on social media, posting nonsense crud, pretending that nothing is happening, or that their guru is an innocent victim of some larger 'evil' plot.
We are positive that the inner-circle spends copious amounts of time of plotting and scheming how to continue on and defraud people as well as wreak revenge on victims, whistle-blowers, bloggers, journalist, the police, and everyone. We hope that they have sleepless nights.
For the rest of the poor little termites that are trapped, they have their routine and have been brainwashed with the 'unclutched' techniques where reality has no connection to their daily thoughts. Others have been told that this is just a 'test' and that soon their Satan Claus will reward them for their unquestioning loyalty.
The good news is that it will be very hard for Sex Swami Nithyananda to conduct any of his high-priced programs. Even if he conducted these via video-conference, a digital trail will lead straight to his hideout. All those involved with setting up the event would be questioned and possibly detained.
The CID police should now have every right to monitor their activities and conduct raids into the ashram at will. The law is not on Nithyananda's side now. We should soon see developments.
Interestingly, even with slave labor it still takes a lot of money to keep the ashram running. Electricity, food, and other expenses won't stop. Legal expenses to retain lawyers who don't show up and defend them will need to be paid. How much Nithyananda took his cash into hiding and how much the ashram has available to cover its expenses is unknown. But, we are sure that they will not be cash-positive. Pressure will be on for the loyal brainwashed 'donors' to fork over more money. But, their greedy eyes might just be opening and might want to take a wait and see.
All of this should spell trouble for Nithyananda and his cult.
Yes, the world would benefit of the epicenter of such evilness is shut down. After the scandal of 2010, the hell-hole was nearly shut down with most of the inner-circle retreating to unknown locations, where they operated their war room. Almost everyone except a handful of people left.
This emptying the rats nest could still happen now. All it would take is a court order to allow the CBI to investigate the alleged murder of Sangeetha Arjunan. The criminals would flee like roaches with the lights on.
More good things could happen. This is just a start. We'll let everyone know what happens as it happens. Stay tuned.

Yes, there's a lot of sensational footage with Sex Swami Nithyananda and Ranjitha Menon, re-branded as 'Ma Nithyananda Mayi Swami' (Swami? yeah, we bet that she has a lot to teach), romping around in Nithyananda's private quarters.

And, the submitted forensic evidence has a lot of other damning material. Of course, most of the media attention went to the sleaze videos. On public relationship side, Nithyananda's abuse of trust and disrespect to the sacred kavi cloth has been most damaging to Nithyananda. But, there's lots of other evidence submitted to the Court. On a legal side, the additional evidence could be more damaging that the sleaze videos, especially to the other defendants.
Regardless, none of this is good for Nithyananda's camp. The fact that the attorneys didn't show up and argue it makes it even worse for Nithyananda.
Perhaps Nithyananda's war of attrition is so effective that even his own legal team has been worn out. We wish that we could hear their sorry excuses to a very upset Nithyananda.
Perhaps this latest appeal to the High Court is CV Nagesh's way of trying to restore confidence with his client. We sure the tension is there. Not good for Nithyananda's side. We will see if this leads for more mistakes.
Regardless, Nithyananda is as slippery as they come. And, we are certain that he will try his best to slither away. He is quite adept at this, but the CID have about as strong of a lock on him as they can get.

Well, that didn't take long. Nithyananda's excuse for not appearing or FTA (failure to appear) as its known in some countries is that he is wondering while observing Chathurmasa Parikrama. Apparently, Nithyananda is still in touch with his attorneys and immediately filed an appeal to the High Court of Karnataka.
We presume Nithyananda's latest appeal is regards to his FTA. As stated in the court's cause list:

But, if it is not for the FTA, then we'll let everyone know after more information is posted on the Court's docket.
But, for now, this appeal s on the Court's calendar for this Monday, 10 September 2018 in Court Hall 16 as line number 17. So, it might or might not be heard on that day.
Listed as the attorney of record is Raghavendra Rao B.K., who is CV Nagesh's junior attorney. He will probably have to hang out at the High Court all day to see if the case is called or not. Obviously, CV Nagesh has better things to do than cool his heals and wait around for an appeal that has no case.

DeleteWe just reviewed the Ramnagar Court's Order of 10 July 2018, which is listed on the case status of Nithyananda's latest appeal. It appears that this appeal is regards to the official Court translator. Since this was the same translator that translated Tamil into English in the charge sheet (the indictment papers), the translator is listed as a 'witness' in the charge sheet.
Nithyananda's attorneys are clutching straws, so they object to this translator and filed an appeal to the High Court of Karnataka after the trial court rejected their arguments. Nithyananda's legal counsel is asking for a stay until this is resolved.
So, this is a breaking development. We'll post more as soon as we find out and that it is official.

DeleteThanks, Anon, for your comment. This looks like to us just another attempt for Nithyananda's legal camp to try to delay and derail the trial. It is weak. But, if someone throws enough spaghetti at the wall, some of it just might stick. What a mess.
As a 'breaking development' the appeal is brand new to us. And, we just assumed that it was in regards to the recent non-bailable warrant for Nithyananda's immediate arrest. We now think that it is in regards to Nithyananda's lawyers objecting to the official appointed Court translator.

Bangalore: The Nithyananda Swamy filed a petition seeking a repeal of the bail plea of the 3rd Supreme Court in Ramanagar.
The apex court bench of the High Court, hearing the petition, directed the government prosecutors not to arrest Nityananda Swamy. The trial was delayed on September 17.
The
Ramanagar court had issued a warrant for the absence of a court in the case for rape charges .

Thanks, Anon, for staying on top of the news. Here's the scoop. Nithyananda's legal team filed a SECOND appeal (remember the first appeal is in regards to Nithyananda's legal counsel objecting to the officially appointed translator for the Court:

A date set for the hearing has not been set. We probably can thank Ganesh Chaturthi that is this Thursday, 13 September 2018, for setting up an obstacle.
We expect that the High Court might entertain this motion next week especially if Nithyananda greases the machine in his direction. (We have noted that Nithyananda's motions often are immediately heard, while other motions, e.g. whether to allow the CBI to investigate the alleged murder of Sangeetha Arjunan, just languish week after week.)
So, until that motion is heard and granted, there is no relief. That means the non-bailable warrant is still in effect.
The trial court will meet this Friday, 14 September 2018. Nithyananda will certainly not be there.
Also of note, Siva Vallabhaneni's legal counsel also did NOT file a motion. So, the non-bailable warrant out for his head is still in effect to. The CID knows his last address of record. It will be interesting whether the CID bag him or allow him to appear and grovel. Or, maybe Siva ditched is sick wife and decided to observe Chathurmasa Parikrama in a neighborhood bar.

It was heard today. Honorable P.S.DINESH KUMAR ordered Nithyananda's legal team one week for compliance. Apparently, the motion had defects, i.e. something wasn't done according to the rules, and the judge gave them one week to fix it. This is common.
Whether the motion is heard or not next week is anyone's guess. But, the defects need to be corrected. That is for cetain.

Today, 14 September 2018, Nithyananda had another hearing in the Ramanagara Court, with Honorable Judge, Gopal Krishna Rai T. presiding. This is the same judge as previous hearings.
Swami Nithyananda (A-1), Siva Vallabhaneni (A-3), and Ragani Vallabheaneni (A-5) were absent. Sri Nithya Sadhananda, a.k.a. Mr. T. Dhanasekaran (Ayya), (A-4) and Ma Nithya Sadhananda, a.k.a. Ms. D. Jamunarani (A-6) appeared.
We had a mixed result, but on the whole, the balance is in the side of darma.
The good news. Both primary victims, Aarthi Rao and Lenin Karuppan, are allowed to be represented with attorneys of their choice. Although there is a pending appeal with the Supreme Court that would allow them to be represented, it appears that they filed a petitiion under different India Penal Code (IPC), which is 301(2) and the judge granted this order.
So, the victims now now represented, which should strengthen the legal fight. Hooray!
The other piece of good news it that the last chance for Ranjitha Menon, a.k.a. Ma Nithyananda Moyi, which is known as 'The Lady' in the court documents (very generous), to have her sex video with Nithyananda thrown out and have the cult's concocted, albeit very expensive, "evidence" introduced into the Court was rejected. Once day, Ranjitha will just have to own up to the undisputed fact that it really is her in those sleaze videos.
True to cult form, we expect that the cult will file appeals in the High Court of Karnataka to both victories.
The bad news, which really isn't so bad, is that the Court has stayed the non-bailable warrants (NBW's) against Nithyananda (A-1) and Siva Vallabhaneni (A-3) until the High Court of Karnataka decides the matter. Right now, the date for the High Court's next hearing is this Monday, 17 September 2018.
However, as we can see, the High Court is a busy, busy, busy place and many scheduled hearing just don't get heard. In previous appeals that stayed the case right before and after the framing of the charges were fast tracked in light of the Supreme Court's December 7th 2017 order that demanded that the case proceed without delay.
If the High Court minds the Supreme Court's order, we could very well have a decision this Monday. However, this appeal gets bogged down, then it could drag on. However, with Aarthi and Lenin now represented, their attorney's could file a motion for a fixed date and move things along. So, this stay could be very temporary indeed.
The next hearing date set for the Ramanagara District Court is Thursday, 27 September 2018. Less than two weeks away. The purpose for this upcoming hearing is SUMMONS. So, the trial court really thinks that the High Court could resolve the Nithyananda's appeal of his non-bailable warrant (NBW) by then. We will see.
It will be interesting to see if Nithyananda appears for his next money-making Inner Awakening Program that is scheduled to start tomorrow, Saturday, 15 September 2018. Even showing his mug on a two-way video conference could have enough digital evidence for the police to trace him back to his hideout. So, this leaves Nithyananda in a bit of a dilemma whether to appear to help make money and assure his enslaved ashramites that everything will be kind of like it was before he started to hide OR risk being rooted out and placed in jail once the stay against his non-bailable warrant (NBW) is removed.
So, the drama continues.

ReplyDeleteThanks Anon. Good question. Well many different scenarios could develop, but the Court has stated:
"Hence, it is just and necessary to post the matter after 17.09.2018."
AND
"Therefore, this court is of the opinion that, it is just and necessary to await further orders from the Hon'ble High Court of Karnataka."
So we suspect that nothing in the immediate future will happen against Nithyananda if the High Court does not hear and rule on the matter. However, the trial court in Ramanagara has placed its next hearing date on 27 September 2018, as a marker to help move things along. If the appeals are still stalled in the High Court, then the the lower court could take the steps to change its order and give new direction. However, we see this court taking a cautious approach to justice and letting things run its course BEFORE it brings down the hammer. So, we believe that the Court would probably give the High Court another two week to move things along. (Be mindful that this Court already brought down the hammer against Gopal, Siva, and Nithyananda. So, it is quite capable and ready to do just that.)
Another scenario is that the High Court hears the appeals timely and rules against Nithyananda and Siva Vallabhaneni. At that time, the CID could make an arrest or go back to the Court on the 29th and ask for appropriate warrants to search Nithyananda's ashram and seize assets, etc. BEFORE bringing down the hammer.
Regardless, we will know more on the 17th and the 29th. Stay tuned.

DeleteThanks for the quality comment. Yes, that would be good. Nithyananda is still spreading his marketing message. We received a Tweet that he will have a live conference on his Facebook and ENTV tomorrow, Sunday, 16 September 2018 at 8:00 P.M. IST. He just doesn't stop.
Back in June 2010, the Court first granted bail to Nithyananda on the condition that he could not lecture. A week later (and perhaps one million USD later, we suspect) and that restriction was lifted.
Therefore, it wouldn't be too much to ask the Court for an order to ban him from lecturing and his social media accounts including YouTube, Facebook, etc. were frozen or placed offline. There is precedent.
Regardless, we are at the final stage of putting an end to this pit of evil. But, the sooner the lid is shut, the better for all of humanity.

Quick update. Apparently Siva Vallabhaneni did file an appeal to his non-bailable warrant (NBW) in the High Court of Karnataka. Its status is still 'pending for admission'.
We also checked the Cause List (scheduled list of hearings) in the High Court of Karnataka. We did not see any of the Nithyananda appeals set for either Monday or Tuesday. But, that might be subject to change. So, we'll check again on Monday morning, IST.

Also request you to reveal some threatening emails/court orders from the Sangha that you've personally received (with names removed, if you like).

Just checked the daily cause lists for today and tomorrow (17 and 18 September 2018) in the High Court of Karnataka's website.
None of the appeals mentioned above are listed. Specifically:
CRL.P 6927 / 2018 : Siva Vallabhaneni's appeal of the non-bailable warrant (NBW)
CRL.P 6920 / 2018 : Nithyananda's appeal of the non-bailable warrant (NBW)
CRL.P 6243 / 2018 : Nithyananda's appeal to the court translator
CRL.P 4102 / 2018 : Siva Vallabhaneni's appeal to the incorrect IPC (Indian Penal Code) number assignment
But, the Ramanagara Court's order of Friday, 14 September 2018, implied that Nithyananda's attorneys said that the judge of the High Court of Karnataka has set the hearing date and that the judge also said that Nithyananda and Siva Vallabhaneni's arrests should be stayed (halted). As per the Ramnagara Court order from last Friday:
"It is submitted (by Nithyananda's attorneys) that, matter is posted to 17.09.2018 before the Hon'ble High Court of Karnataka. "
"Learned Spl.PP (Nithyananda's attorney) has also submitted that, there is *oral* directions from the Hon'ble High Court of Karnataka not to execute the warrant as against A1."'
(the *emphasis* is ours)
So, Nithyananda's attorneys claim that there is oral (not written) direction from the High Court to delay everything, but nothing is happening on the date that these attorneys said that it would happen on.
It would be most helpful to obtain an official court transcript (written record of what was said in court) from the High Court of Karnataka for every one of the appeals that was before a judge last week. Then we can see if Nithyananda's attorneys are telling the truth or if they have committed acts of perjury.
If these attorneys did commit acts of perjury to deceive the court and gain an unfair advantage, then these attorneys and their clients should be punished to the full extent of the law.

DeleteThanks for the updates! Yes, CRL.P 6927 / 2018 : Siva Vallabhaneni's appeal of the non-bailable warrant (NBW) was heard yesterday.
It appears that the High Court is linking Siva's NBW appeal along with Nithyananda's NBW appeal (6920).
So, here are two issues:
1) Siva's NBW appeal (6927) is scheduled to be heard on Wednesday, 26 September 2018. That is the day *before* the next hearing date in the main trial in Ramanagara District Court. So, it will be easy for Siva to hold up the trial court because it takes a day or two before the official orders from the High Court make it down to the trial court. So, this new date could be seen as a delay tactic to buy the cult another week or two.
2) More concerning is that Nithyananda's NBW appeal in the High Court of Karnataka (6920) is *still* pending admission. Hmmmmm. Makes us wonder. Now if Siva's NBW appeal is now tied with Nithyananda's NBW appeal and Nithyananda's appeal has not even been entered into the High Court, this gives the cult a 'golden' opportunity to delay the whole trial. The cult will claim that their appeals are not heard in the High Court and that the stay (break) from the trial court should just be continued until their appeals are finally heard. These appeals could be conveniently never heard for months if the cult has used its back channels, which it seems to have done in the past.
On the positive side, we are certain that the CID police are on top of these delay tactics. And, the trial court (Ramanagara District Court) certainly has intent to fulfill the 7 December 2017 Supreme Court Order that there should be no delay in getting the trial started. So, these delay tactics might gain the cult a few weeks, but there is little chance that it could derail the trial as the cult certainly hopes it would. If anything, the judge in the trial court could certainly view their antics, posturing, and maneuvering in unfavorable light. Yes, the cult's short-term gains could have lasting unfavorable consequences.
We're not certain how the law works in India, but in general, as long as there is NOT a court order to have a stay (relief) from the High Court, then the trial court is under no obligations to go forward and proceed. If the trial court should allow the CID police to arrest Nithyananda (A-1) and Siva Vallabhanenei (A-3) until the High Court produces that official stamped *written* order, then it might force the cult to have the High Court hear both appeals immediately in hopes of gaining a stay.
On a different note, we do not know what the "office objections over ruled" means as written in the High Court's docket (6927). Perhaps 'Official objections overruled'? If yes, then were those objections raised by the CID police attorney or by the cult attorney? Regardless, the next High Court hearing is scheduled for next Wednesday. The next trial court date is scheduled for the following day after on Thursday, 27 September 2018.

Office objections are objections from the court's administrative department, usually relating to what they feel procedural lapses or other paperwork errors in a petition. Till the office objections are either corrected by the petitioner or "overruled" by those reviewing, the case will not get filed and scheduled. In this case, the objections were overruled, so the case was filed and scheduled. This is my interpretation from the limited data available.

DeleteThanks, anon, for the comment. Yes, we heard stories about how Nithyananda has returned to his ashram and was visible on his Facebook 'live' satsung. So, we tuned in today and watched.
And, yes, there he was doing his best to lock in his faithful and even recruit a few new people who were on their way to being trapped.
Nithyananda spoke with confidence about how a renowned mystic from his hometown, Tiruvannamalai, Yogi Ramsuratkumar, brought back to life a dead person who was headed to the cremation ground.
Nithyananda swears that this is true and that there are at least 50 people still alive that can testify that this is true. (Ramsuratkumar died in 2001.) And, Nithyananda repeated again and again that this really was true.
Nithyananda then went on to say that if followers can 'kill' their own forgetfulness, that they too will be enlightened just like Yogi Ramsuratkumar. And of course, Nithyananda will provide the tools in order for his followers to 'kill' their own forgetfulness just so that they all *remember* who is controlling who here.
Perhaps being in samadhi is not the same as forgetfulness. Nithyananda's most common response to all the embarrassing questions and police interrogations is that he was in samadhi at the time.
Regardless, the fuzzy edges of Nithyananda's hair and body against the backdrop of his throne in Bidadi strongly suggests that the 'live' video on Facebook was a green-screen overlay to make it look like he was there. But, he was not. There also were no panned shots or wide-lens views to show the audience or anything else to suggest that this wasn't a 'teleported' setup.
So much for interrogatory.

The good news is that the High Court of Karnataka finally entered Nithyananda's appeal (6920) and linked it to Siva Vallahaneni's appeal (6927).
Yesterday (26 Sept. 2018), the tied cases were listed number 68 in the cause list. So, we doubt that it would be heard. But sure enough, the cause list roared along and then like magic it jumped from 67 to 69 without ever displaying nubmer 68. (69 would have been an appropriate number for their case.)

It appeared that the two attorneys for the cult, C.V. Nagesh and Ravi B. Naik, asked the High Court to delay the hearing until Friday, 5 October 2018.
The High Court granted their delay.
Now, this contrasts to what the cult attorneys told the Ramanagara District Court in the main trial two weeks ago. They promised the Court that their appeal would be heard the following Monday of 17 September 2018. Now, nearly two weeks later, these same attorneys are asking for another week's delay. Lies and manipulation. Just like their clients.

What appeared to be a procedure loophole that was designed to protect legitimate religious organizations from frivolous litigation, leave it to Nithyananda to use that safe guard to continue his fight for the 293 seat.
Nithyananda's attorneys successfully argued that the procedure to block Nithyananda was not followed.
"A law suit has to be filed either by the commissioner of Hindu religious and charitable endowments (HR&CE) department or by any two or more people having interest after obtaining the consent in writing from the commissioner."
This latest order could be challenged in an appeal or a fresh claim could be filed that follows this procedure.
So, what this means is that for now Nithyananda found a way to continue the fight and clog up the courts but he is not going to be installed as 293. So, there will be more hearings, etc. over the 293 position. But, given the past orders and outcome, Nithyananda will have a very long struggle just to stay in the race.
The silver lining with this development is that the Madurai Aadheenam will continue the fight against Nithyananda and drain the cult and his resources.
Stay tuned for more drama. A lot more drama. We bet that Nithyananda will launch appeals from prison even with seven life sentences.

As a side note, last Tuesday (25 September 2018), there was a hearing in the Ramanagara District Court for Gopal Reddy Sheelum (Sri Nithya Bhaktananda), a.k.a. A-2.
Of course, Gopal was no where to be seen.
The poor chap who is about to become even poorer, Sathish Selva Kumar, R-2, who hold the property that once secured (past tense) Gopal's bond, did show up. He asked for more time. Desperate. And, the Judge granted him 30 days.

Trial court has made it clear that has not recalled the NBW. Although PP has said that there is no stay by high court on NBW and requested the court to issue the process of NBW, since it’s under challenge in the high court matter has been adjourned to oct 10th.

The Ramanagara District Court held the scheduled hearing against Nithyananda (A-1) and the other accused (A-3 through A-6) [Note: Gopal Reddy Sheelum (A-2) has been separated from the case as he has been absconding.]
None of the accused showed up.
The judge, Honorable Gopal Krishna Rai, heard from Nithyananda's attorneys that their appeals to the non-bailable warrant (NBW) in High Court of Karnataka would be heard with a 'fixed date' of Friday, 5 October 2018. The Judge also confirmed that there was an oral instructions from the High Court not to execute on this warrant.
The attorney or prosecutor (Spl.PP) representing the CID Police requested that a fresh non-bailable warrant be issued against Nithyananda (A-1) and Siva Vallabhaneni (A-3) because there is no official (written/stamped) stay (relief) order from the High Court. Oral instructions don't hold up. Court endorsed stamped orders do.
The Ramanangara Court Judge decided to allow the High Court to hear the case on Friday, 5 October 2018 without executing the warrant. But, the Ramanagara Court also has not recalled the NBW either. It still sticks and is firmly stuck on Nithyananda and Siva Vallabhaneni.
The Judge declared that the next hearing date will be in two weeks on Thursday, 11 October 2018. On that day, it will submit the primary witness, Aarthi Rao, evidence and oral statement to be recorded on record.
So, Nithyananda and Siva Vallabhaneni will get a two-week break to fret a little more. Like trapped mice in a room, they are hiding, but there's very little maneuvering that they can do at this point.
Worst case scenario, they pull a similar stunt and delay the hearing for their appeal for the NBW's. Two weeks later, the Ramanagara Court Judge could then decide to issue fresh non-bailable warrants against them. He could also decide to let them have one more chance for the High Court to hear their appeals. But, still the trial will go on and the star witness, Aarthi Rao, will enter her statements as evidence.
Another 'worst case scenario' is that the High Court of Karnataka somehow decides to grant Nithyananda and Siva Vallabhaneni a stay and remove their NBW (very unlikely). If this was done, then the case would march up to the Supreme Court on expedited urgency. The Supreme Court would then see that its very own order of 7 December 2017 that specifically states that there must be no delay in the trial is being disrespected.
Not even a dishonest judge from the High Court of Karnataka would want to incur the wrath and humiliation from an angry Supreme Court of India. That would be a career-stopper. Only attorneys with the thickest of skins would want to blatantly disregard the Supreme Court either. But, Nithyananda's attorneys have shown no integrity nor moral compass. There isn't much difference between them and Nithyananda's inner-core. So, the short of it, is yes, they will be there. But the karma and consequences will also be there for them. Waiting.
So, Nithyananda and Siva Vallabhaneni are trapped. And, the trial court will continue with or without them.
They will just get a two-week's worth of relief until the bounty hunters come looking. And, the star witness will make her debut.

Please be aware that a huge number of continuous court holidays are approaching in October, November and December due to various important festivals and observances. This has likely always been one of the many parallel strategies of Nithy's lawyer, to postpone the hearing till Oct-Nov so that the courts find it harder to set a date till January next year.

Today, accused No.1 and 3 are not present before the court. The order with regard to issuance of process of NBW as against A1 and A3 has not been recalled by this court.
Similarly, the order of issuance of NBW as against A1 and A3 is under challenge before the Hon'ble High Court of Karnataka.
Therefore, this court in the absence of A1 and A3 is not in a position to proceed further in the matter despite there being directions by Hon'ble Supreme Court of India to dispose of the matter expeditiously.
It is brought to the notice of the court that, date is fixed for hearing is 05.10.2018 before the Hon'ble High Court of Karnataka.

Yes, we remember that this one one of many lawsuits filed on behalf of the cult of Nithyananda. Nithyananda went after TV 9, Suvarna News, Kasthuri, Udaya, Janashri, Public TV, ETV, Samaya 24x7, and News 9 (the English channel of TV 9). Basically, if there was a news channel in Kannada that aired his defaming video, Nithyananda sued them.

This case is interesting for a number of reasons. First, Nithyananda himself is the petitioner. Rarely does he do his own bidding. He does have a direct case against Aarthi Rao (along with several other separate cases from his minions). But, rare is he the main petitioner.
Second, SRI. MEGHACHANDRA D N is an unknown attorney. It is not from Nithyananda's list of common 'go to' top criminal (minded) attorneys that is part of Nithyananda's legal A-Team. Apparently, he was absent too. Perhaps Nithyananda did not pay him or he woke up and saw how bad Nithyananda is. Usually, there is a process to do a substitution of attorneys.
But, it is noted that the cult had already abandoned one known case. That was an out-of-state strategic legitation against public participation (SLAPP) lawsuit against yours truly. Kavita Gaddam and her husband, Sri Krihsna Challa as well as Chitra Hariharan, Siva Vallabhaneni (A-3), Gopal Reddy Sheelum (A-2), and Sri Sadhananda (A-4) led up that suit. The cult hired the big guns from K.L. Gates Law Firm (that's the law firm that Bill Gates' dad started). These attorneys realized that the cult deceived them and back down in a hurry. So, crushed was the cult, that it had over seven months to find an attorney to replace the attorneys from K.L. Gates. No takers. The frivolous lawsuit was dismissed. Ah, but we digress.

DeleteOther interesting facts from this case is the General Power of Attorney (GPA) is given to another unknown, Nithyananda Deepan, who is the son of Nithya Sarvananda. So, this looks like a cult family. (Both father and son adopted Nithyananda's cult name.) Perhaps this is the weak link that sunk Nithyananda's failed appeal.
(NOTE: Nithyananda loves to get his followers to start lawsuits and then have them finance them. Nithyananda tried to get Sri Nithya Praba from the L.A. Ashram to go after another ex-devotee/almost ashramite back in early 2008. The case was alleged 'slander'. The ex-devotee who was accused of slander was one of Nithyananda's alleged male tantric partners. Fortunately, Sri Nithya Praba was smart enough to trap Nithyananda into forcing Nithyananda to produce hard evidence that it was, indeed, Nithyananda who was initiating the lawsuit. Nithyananda refused to comply. So, the lawsuit never happened. Fortunately, Sri Nithya Praba escaped the cult about six months later after that incident.)
With at least 50 hearings in the trial court in Bengaluru, this was not a cheap litigation. Even if this was a 'budget' attorney, it would have cost the cult or perhaps Nithyananda Deepan about $200 to $300 USD per appearance. If Sri Nithyananda Deepan was force to fund it, then it would be at least $10,000 USD, but more likely in the neighborhood of $30,000 to $100,000 USD or greater. Ouch.
The actual order was from High Court of Karnataka on September 26th, 2018:
None present for the petitioner. Nobody appeared for the petitioner even on the last occasion i.e., on 10.09.2018.
In view of consecutive defaults, it appears that the petitioner has lost interest in prosecuting this petition any W.P.No.5589/2014 further and there appears no reason to continue with this petition on Board.
This petition stands disposed of with liberty to the petitioner to apply for restoration, if so advised, while observing that the Trial Court may proceed with the matter in accordance with law.

So, the judge left the chance that Nithyananda could revive this case. But, checking the court docket, the last hearing was in 2012. Looks dead to us.

DeleteThe next morning, Aarthi Rao and Lenin Karuppan along with their attorney went to the Ramanagara District Court and appeared before the judge that issued the non-bailable warrants (NBW's). There is a legal procedure to have a NBW removed when it is freshly issued. And Aarthi and Lenin followed that procedure.
The judge was satisfied. Around 3:00 P.M. IST on Thursday, October 4th, 2018, the non-bailable warrants were removed. Done.
But wait! the story is not over. The best is yet to come.
The cult was anticipating that Lenin and Aarthi would attempt to have their NBA's removed. So, the cult sent its thugs over to harass and intimidate them. One such nasty fellow was a cult member named Sachin. He was accompanied by Ma Nithya Achalanda, another cult member known for her bad temper and temperament. Sachin decided to follow around Aarthi with his phone's video camera locked on and recording Aarthi's every step. Aarthi confronted the harassing thug, Sachin, and asked why was he doing this? And, also said that she did not consent to being videoed.
Sachin now engaged in conversation with Aarthi proudly said that he was a follower of Nithyananda (a big damning omission.) Then he went on to say that if Aarthi appears as a witness against Nithyananda's rape trial, that Aarthi's life would be endangered.
Apparently, Sachin didn't get the memo that the Ramanagara District Court is full of attorneys and police officers. And, he made his death threat within the earshot of all of them.

The end result? Nithyananda's proud follower, Mr. Sachin, was arrested with a First Incident Report (FIR) under IPC 506 "Criminal Intimidation".
This crime can be punished with a fine and/or up to two years in prison. Not bad, for one day of harassing.

Oh, yes, Mr. Sachin's phone along with all his freshly recorded video evidence was also confiscated.
To our knowledge, Ma Nithya Achalanada was not arrested...yet. But, after the police examine the video and other evidence found on Sachin's phone, she (along with others) could be arrested. This could get really good especially if there's evidence that the cult generals instructed Mr. Sachin to systematically harass and intimidate the victims. The paddy wagon could become very full on its way way journey from Nithyananda's ashram to the police station.
So, Nithyananda's cult followers can continue their dance party and celebrate Mr. Sachin's release from jail and his granting of bail.
Dance on, blissful party goers. Ignorance is bliss. And, Nithyananda's cult is radiating in it.

But, we are 98 percent certain that only one (1) follower of Nithyananda was arrested, that is Mr. Sachin. Ma Nithya Achalanda could have been called in for questioning, but was not arrested.
We are 100 percent certain that the charges are IPC 506 "Criminal Intimidation". The fact that dumb-as-paint Sachin did film inside the court compound and certainly committed an illegal act and brought unwanted attention to his intimidation. The actual criminal charge on his FIR, however, was IPC 506 "Criminal Intimidation".
The victims will certainly be able to bring this act and other acts such as the nearly 20 false cases against them as proof that Nithyananda and his cult are harassing them.
This could get a lot of traction. Time will tell.

DeleteInteresting note. The assigned judge for Court Hall no. 15 in the HC of Karnataka is no other than Hon'ble Mr. Justice John Michael Cunha. (Court Hall no. 15 is where all four Nithyananda HC appeals are being heard right now.)
Judge John Michael Cunha is the same judge that convicted Ms. Jayalalithaa, then Chief Minister of Tamil Nadu, in her 18-year-old Disproportionate Asset case back in 2014. Hon. John Michael Cunha was the fifth judge in that case and was assigned to do the job by the Supreme Court of India. So, he was the stopper and got the job done. His conviction against Ms. Jayalalithaa was later upheld by the Supreme Court of India. He sentenced her four years in prison and fined her RS 100 crore, about $13,500,000 USD. Ouch.
Hon. John Michael Cunha once also stood up to Ms. Uma Bharti, then the Chief Minister of Madhya Pradesh. He refused her appeal stating that it was stale for almost two years had passed. He also rejected as defective a petition filed by Government of Karnataka that sought to reopen Bharti's case. Blocked.
So, this is one tough judge that certainly has a track record of not selling out and is well respected by the Supreme Court. Fingers crossed.

But, on the case status pages of the four appeals in the High Court states that Hon'ble P.S. DINESH KUMAR is listed as the presiding judge. Both judges seem reputable and honest, but we thought it was necessary to clarify this point. This coming Tuesday, we will try to find out which judge is presiding over these appeals.

Nagesh, the same attorney that changed the story from "Nithyananda is incapable of having sex" to "all the sex that Nithyananda had with his disciples was consensual" addressed the court. C.V. Nagesh said that he was not feeling well and asked that the four appeals to be heard on this coming Thursday on 11 October 2018.
Although that seems like a 'reasonable' request of just two days, it just so happens to be the next hearing of the Ramanagara District Court where the main criminal trial is being held was scheduled for that very same Thursday, 11 October 2018. So, once again, Nithyananda's legal team is dragging its feet with weak excuses and probably will delay the trial for at least a week.
The good news that the judge at the Ramanagara District Court is extremely sharp and takes the Supreme Court's ruling of December 7th, 2017 very seriously. There shall be no delay! When it hits his ears that the trial is delayed because C.V. Nagesh, who was well enough to appear, was not feeling well, he just might take some action. We will see this Thursday.
On an incidental note, the presiding judge for the High Court of Karnataka is Honorable Justice P.S. Dinesh Kumar and not Hon'ble Justice John Michael Cunha. Confirmed.

Last time, he said that he was not feeling well. Apparently, Mr. C.V. Nagesh is not receiving Nithyananda's healing abilities as advertised on its website. Pity.

On Thursday, 11 October 2018, there were two court sessions. The Ramanagaraga District Court with Honorable Justice Gopal Krishna Rai T. presiding, adjourned the hearing for two weeks because the High Court was still deciding the four appeals. This was expected, but we were hoping that it would have been just one week. Still, with the holiday season in high gear, this is not so bad. Patience.
The four appeals in the High Court of Karnataka with Honorable Justice P.S. Dinesh Kumar presiding were also heard yesterday, Wednesday, 11 October 2018. The arguments went for two hours. The good news is that the Advocate General of Karnataka appeared and argued for the State of Karnataka and against Nithyananda and Siva Vallabhaneni. This is a BIG deal. The Advocate General only appears rarely on very select cases. So, Nithyananda's case is very high profile and has attracted more attention than the 'divine' avatar could possibly want. Therefore, the judge knows that all eyes are on this case and that he better be able to justify his ruling, either way.
Apparently, Nithyananda's attorney, C.V. Nagesh, purposely dragged on his counter arguments so that he 'ran out' of time. Therefore, the judge granted his request to continue the four appeal on Monday, 22 October 2018. Such gamesmanship.
We're sure that CV Nagesh will be aiming to try to delay the hearing so that it drags out to the 25th of October. That way, he will 'win' his clients another two weeks of borrowed time. However, his counter arguments cannot take eternity, so the cards are stacked against him in order to secure another delay. We doubt the court will tolerate another 'sick' day either.
We'll see what happens on Monday, 22 October 2018. Stay tuned.

The eye patches are applied with nice BIG gaps where the transparent edges cut in over 1 centimetre from the main patch, which allows the enlightened charlatan plenty of space to read and see everything.

So, the simple thing to do is buy a box of these patches. Test them out, and make a video of them. We look forward to it.

This gets complicated and too much for us to always track. Perhaps we should set up a public calendar on Google so that everyone can see what case is next and how many retaliation cases are against the victims. Too many to count.
Remember how Gopal Reddy Sheelum (written in the Ramanagara Court docket as: Gopala Sheelam Reddy @ Nithya Bhakthanandha), A.K.A. A-2? Yeah, he is absconding, so the Court separated his case from the other alleged criminals. It turns out that there are two cases that now appear under the once heir to Nithyananda's criminal empire. They are:
1) S.C./52/2018 (all the criminal charges against him - the main case)
2) Crl.Misc./324/2018 (this is the bond - surety issue that covers that Gopal is absconding.)

On 15 October 2018, a hearing for the main criminal case against Gopal Reddy Sheelum was heard. Of course, Gopal was no where to be seen. Surprise. Surprise. Surprise.
The judge asked why hasn't the non-bailable warrant out for the immediate arrest against Gopal Reddy Sheelum been executed. Well, Gopal is out of the country. OK, next hearing on 19 November 2018.
There is nowhere but prison in Gopal's future. He might be sipping on Starbucks coffee today, but as soon as Homeland Security (the Immigration Dept. in the USA) catches on, it will be the end of Gopal. A very bleak future for such a nasty man. Fitting.

After being stuck on case no. 43 for what seemed to be the longest time, the High Court of Karnataka went into high gear and zoomed up to case no. 50. So, today the four appeals will be heard today and hopefully ruled on.

Today, the High Court heard all four appeals for its third day of arguments. Nithyananda's attorneys were successful to delay and drag out the proceedings one more day.
The next (continued) hearing for the four (4) appeals will be this Friday, 26 October 2018.
Although just a few-day delay seems benign enough, this overlaps with the next court hearing at the Ramanagara District Court where the main criminal trial is happening. The next scheduled hearing is on Thursday, 25 October 2018, which is conveniently the day before the continuation of the High Court appeals.
The presiding judge at the Ramanagara District Court will certainly see through these tactics, but most likely will continue its hearing after the High Court rules on these four appeals. The Ramanagara District Court could either set the next hearing out by one or two weeks.
Even if the High Court finishes all of its oral arguments, there is no guarantee that it will rule on the four appeals swiftly. This could drag out the proceedings even further, but will be in clear violation of the Supreme Court's December 7th, 2017 ruling that states the trial should go forward with no delays.
So, let's see what happens this Thursday and Friday. Justice will be served up against Nithyananda and his thugs. Just wish that the High Court stops catering to Nithyananda's antics.
But, as the trial sits at a standstill, the lack of activity and more pronounced the lack of funds are taking their toll on Nithyananda's crumbling empire. Nithyananda's deliberate delays are slowly choking himself. So, there is some relief in that thought.

Today, Thursday, 25 October 2018, the Ramanagara District Criminal Court had scheduled a hearing for Nithyananda and the other four accused (minus Gopal, of course). Since Nithyananda and Siva Vallabhaneni have four appeals in the High Court of Karnataka, none of the accused bother to show up.
We expected that.
The good news is that the judge set the next hearing to be in one week and one day. This is very good for the following reasons. One, the four appeals will be heard tomorrow, Friday, 26 October 2018, for the fourth time for oral arguments. There is a high chance that all arguments for the appeals will be finished and a verdict issued. Also, Diwali occurs the week after that on Wednesday, 7 November 2018. Since Diwali lands in the middle of the week, this could wreck havoc with at least two court days gone.
So, we were expecting the court to either hold the next hearing in one, two, or maybe even three weeks. It chose one week.
Next hearing date, Friday, 2 November 2018.

Yes, an update. Nithyananda's attorneys know how to slither. Today, they requested that their cases be heard in the afternoon. We watched the display board skip right over number 26 in the online display of the cause list.
And, wouldn't you know it? There wasn't enough time to hear the case that Friday afternoon. So, the case was never heard today, and pushed off until another time.
Yup, it's called gaming the system.
And, the next date for the appeals in the High Court? Friday, 2 November 2018. The SAME date that the Ramanagara District Court scheduled its hearing.
After November 2nd? With Diwali falling smack in the middle of the week on Wednesday, 7 November 2018, the Court will take three days off. Tuesday (6th), Wednesday (7th) and Thursday (8th).
The Ramanagara District Court most likely will kick the can down by one week and will hold the next session on Friday, 9 November 2018 in hopes that the High Court finally ruled on the matter. But, then again, it might be caught in the holiday crunch and push it off until the week after. Luckily, there are no 'red' (holiday) days the following week.
Certainly, the Ramanagara District Court will see the game that Nithyananda's attorneys are playing and factor that into its ruling. The Court could order 'fresh' non-bailable warrants, but will probably roll with the tide for now. We will see.
On a positive, the High Court of Karnataka is due to shuffle its cases. We don't know if Honorable P.S. Dinesh Kumar who is assigned the four appeals will be replaced or not. If he is replaced, we certainly hope (but almost expect) that the cult's attorneys will drag out the appeals as long as they can in order to 'inform' the judges with the same material that it already presented. Let's hope that the High Court does not tolerate tactics like that.
In regards to the case that involves the alleged murder of Sangeetha Arjunan, this shuffle probably will mean that it would be assigned to a new court house. If the previous court house was paid off to not hear the case, then that could increase the chances that this case will be finally heard.

Remember the last hearing, Nithyananda's attorney delayed it into the afternoon and then the case was never heard. Perhaps these lovely attorneys skid the pan with a little grease. We wouldn't be surprised.
With all these delays, certainly the December 7th, 2017 Supreme Court ruling is not being respected. That ruling called for no more delays. But, what do we get? More delays.

One small note above. Ranjitha's failed attempt to attach a case against the victims in the main rape trial against Nithyananda has been added to the four listed cases. So, now there are five.
Her case is:

Her attorney is HEMANTH KUMAR D.
Ranjitha's case was just admitted to the High Court of Karnataka on 29 October 2018.
So, the cult will try to use this appeal to drag it on for at least another hearing date.
Hopefully, the judge will be wise to this, but we doubt it.

Dang, Nithyananda's lawyers did it again. Perhaps the judge is on its payroll too. For whatever reason, the five appeals from Nithyananda, Siva Vallabhaneni, and now Ranjitha Menon, a.k.a. Ma Nithyananda Moyi, have been continued to this Monday, 5 November 2018. Nothing was heard in court.
We saw the cause list amp jump from 25 to 29. Just like that. So, we knew that something was up.
No doubt, Nithyananda's attorneys will aim to delay again on Monday, for the rest of the week is off for Diwali. Most likely if these attorneys cannot plead for another delay, then they will use Ranjitha's new appeal, which is now tied to the other four appeals, to drag everything for as long as they can.
Meanwhile, the Ramanagara District Court acknowledges that the case has been delayed with the appeals in the High Court of Karnataka and resigns that nothing can be done. This is right at the point that Primary Witness no. 1, our star, Aarthi Rao, is to have her statements entered into the record. The Ramanagara District Court has set the next hearing to be two weeks out on Friday, 15 November 2018, which is not bad considering that next week will be the week of Diwali.

At the earliest point of time more precisely on 06.09.2018 this court has issued process of NBW (non-bailable warrant) as against A1 and A3.
Subsequently, learned Senior Counsels have filed memo on behalf of A1 and A3 stating that, Hon'ble High Court of Karnataka has directed the State Public Prosecutor to issue necessary instructions to the Police Personnel not to execute the warrant of arrest/not to precipitate the matter.
On 14.09.2018, learned Spl.PP representing the State has also submitted that, there is oral directions not to execute warrants as against A1 and A3.
The order of issuance of NBW as against A1 and A3 is under challenge before the Hon'ble High Court of Karnataka. The order of issuance of NBW as against A1 and A3 has not been recalled so far.
Therefore, in the absence of A1 and A3 this court is not in a position to proceed further in the lines of recording further evidence of PW.1.
Hence, the only recourse available for this court is to await further orders from Hon'ble High Court of Karnataka. Accordingly, awaiting further orders from Hon'ble High Court of Karnataka, call the matter on 15.11.2018.

If you search for Bangalore high court and then case number, if you look up 6927 year 2018, there are two cases mentioned on the court web page. One I think is the NBW the other is mentioned as case type CRIME. The number seems to be 141/2010

Once again, the High Court of Karnataka has scheduled the now five appeals by Nithyananda, Siva Vallabhaneni, and Ranjitha Menon for today, Monday, 5 November 2018.
The four appeals are listed as no. 37 in today's 1st list of the cause list.
As before, it is Justice P.S. DINESH KUMAR presiding in Courthouse 14.
Although this number, 37, is higher than previous cause list numbering, there is still a good chance that they can be heard today provided that there are no more delays. That's a big provision.

Sorry for the delay. On Monday, November 5th, 2018, the High Court heard arguments for what seemed over an hour for the now five appeals.
It seems that Nithyananda's attorneys are successful in making an issue where one does not exist. As you might recall that in the appeal, CRL.P 6243 / 2018, Nithyananda's attorneys object that the official translator is listed as a 'witness' because the translator translated the primary witness' statements back in 2010. This translator had nothing to do with the case. But, now Nithyananda's attorneys have their 'wedge'.
So, the court will entertain yet another hearing date this coming Friday, November 9th, 2018 and continue the arguments. Nithyananda's attorneys are somehow trying to draw a connection between this official court translator and the 'Stand Up for Darma' blog that is allegedly run by primary witness no. 2, Lenin, at least that is the attorney for the cult, C.V. Nagesh, is accusing. How there could possibly be a connection? Only the dispensaries in California will know for sure. But, as weak as this argument goes, it bought the cult a couple of more days of delay. Whether clutching these straws will extend past the next Ramanagara District Court hearing, which is scheduled next week on Thursday, November 15th, 2018, is unknown. The cult is trying and the High Court of Karnataka judge is allowing these delays. We look forward to justice being served and the Supreme Court of India Order of December 7th, 2017 respected. No more delays!

As stated from the very beginning, Nithyananda offers red chilies, human hair, and other anomalies into his fire rituals. He used to initiate his enlightenment ritual inside the graveyard in India. Our blog helped stop some of these overt practices.
We also have no problem if someone wants to share about their dreams of black snakes or whatever is relevant to them.
We even don't mind if cult members request to post their comments as long as they follow the guidelines as written below in the EULA stated below. And, sometimes, we post them.
We suspect that some of these comments above just might be from cult members, but it add to discussion. We acknowledge that the cult has gotten a bit more sophisticated in getting its word out than it did nine years ago. But, the source of the cult's comments is rotten. Nithyananda's attorney, C.V. Nagesh, did it again. He filed the day before the last hearing date for personal leave. And, of course, the current High Court judge is only too eager to assist in dragging it out. Delay granted.
So, the court adjourned all five appeals for next (this) week. We thought that it might let Ranjitha's appeal CRL.P 7625 / 2018 to be argued for C.V. Nagesh is not the attorney of record in that appeal. Nope. Not even that.
So, the next hearing date is set for this Tuesday, 13 November 2018.
We checked the cause list for the high court, but the person who maintains that might still be out for Diwali. Only Monday's cause list is showing.
We just checked the 'advanced' (next day) cause list, and sure enough, all the appeals are listed as no. 35 in Courthouse no. 14.

Although we share your enthusiasm to see NithyaRavananda neutralized, we would like it done in the way that does not cause bad karma to you. The cost of poisoning Nithyananda would result in the same karmic price that Nithyananda and his cult followers have already collected from the numerous murders and cheating they have done. Those knowing and willingly commit such crimes cannot be saved in this lifetime.
Patience. The the justice system will eventually get it right. There's checks and balances to ensure that. This one particular judge would appear to be influenced and will certainly pick up his own bundle of bad karma if he is collaborating for more delays.

We were tipped off that the CID planned to file a motion to hold the next hearing date on the 20th, but we kept quiet for confidentiality and not to raise false hopes. We are assuming that this was the reason for the shortened cause, but we do not know for certain.
OK, so there's some hope that the current appeals are being dealt with fairness, albeit very slowly. Relief.

There's been some developments. Mostly good.
First, last Thursday, 15 November 2018, the Ramanagara District Court (the criminal court where the main case is happening) had a hearing. No one showed up and the Court acknowledged that there was nothing it could do as long as a stay (important) was in place while the five appeals are being heard in the High Court of Karnataka. To its credit, the Ramanagara Court set the next hearing date only one week later on Thursday, 22 November 2018.
On Tuesday (today/yesterday) the High Court held yet another hearing for the five appeals. The bad news is that the High Court once again allowed Nithyananda's attorney, C.V. Nagesh, to kick the can down the road until this Friday, 23 November 2018. C.V. Nagesh wanted to speak for two more minutes. Why couldn't the judge allow an extra two minutes in court to allow this never ending bag of wind a chance to release all his gas? But, the Court adjourned the hearing until this Friday. No doubt, C.V. Nagesh wants a chance to try to think of something else to throw at the Court and delay the trial even further.
Now for the good news. The High Court removed the stay. That means, the trial court is no longer delayed until the High Court makes a ruling. So, this Thursday, the scheduled hearing date at the Ramanagara District Court will go forward even though the High Court has not finished its hearings nor made a ruling. This will allow primary witness number one (PW-1), Aarthi Rao, the opportunity to lodge her story into the Court's records. The evidence will be cemented. There's no going back at this stage. It will probably take several hearing to allow Aarthi the time needed. No doubt, Nithyananda's attorneys will try to cross-examine her and do their best to discredit her. Do pray for her. She is a strong lady, but a little extra Divine help could do everyone well.
The CID's ability to execute on Nithyananda and Siva Vallabhaneni's non-bailable warrants will only happen after the High Court of Karnataka hears all five appeals and rules on the matter. So, for now, these (alleged) criminals will not be hunted down.
On a humorous note, the attorney for the CID police made the cult's attorney, C.V. Nagesh, a laughing fool. C.V. Nagesh tried to discredit Lenin and get the translator removed. The attorney representing the CID police turned the tables and had the whole courthouse laughing at C.V. Nagesh. Red-in-the-face, C.V. Nagesh didn't even reply back to the CID's attorney's remark after he was thoroughly humiliated. (A good and deserving karmic punch, if there was ever one. More to come.) Be mindful that this does not mean that the judge will rule in Lenin's favor. Just that C.V. Nagesh was made to shut up to the amusement of all present.
So, this Thursday, the trial resumes. And, hopefully, this Friday, the appeals stop. It then make take weeks before the High Court Judge comes out with his orders. Let's hope he already has a draft ready to file.

Even while hiding, Nithyananda finds a way to create controversy and trouble for him and his cult. This time, Nithyananda made comments on a video about how marijuana is an herb and it is not addicting like alcohol. Although Nithyananda made disclaimers that he was not 'promoting the use' of marijuana, the media picked up on it and had a field day.
Complaints were filed to the police.
A different branch of the police served a criminal summons that demanded that Nithyananda appear before the Central Crime Branch police. (Note that this is a different set of police than the CID that is currently lead the investigation and is leading the prosecution in Nithyananda's rape case.)
As expected, Nithyananda's cult members reacted strongly against this development.

The cult's tactic is to play victim and act as if rioters have already stormed the ashram and beaten everyone to a pulp. Perhaps the cult members should have a nice big helping of Nithyananda's special herbs and realize that this is as close to enlightenment that they will ever get.
Will this new controversy bring down Nithyananda and his cult? Probably not.
Then again, we don't know how aggressive the CCB Police are. There could be some major damaged and more investigations. Let's see.

Here's the court updates. On Thursday, 22 November 2018, the Ramanagara District Court, where the main trial is happening, had a hearing. Neither the accused nor the Special Prosecutor were present. The Court did not receive any orders about the stay being lifted (none were mentioned). Under these circumstances, the judge had really no choice but to kick the can down road one more week until the following Thursday, 29 November 2018.
The next day, Friday, 23 November 2018, the High Court of Karnataka had scheduled a hearing for all five appeals. The drill went like this. Everyone showed up. No arguments were made. And, everyone was told to come back again next week. Yup, you guessed it. On Thursday, 29 November 2018, the same day as the Ramanagara District Court hearing. Supposedly, the High Court of Karnataka will hear the final-final-final arguments and will post the orders.
We'll see if this holds true or not. The HC has dragged Nithyananda's appeals for over two-and-a-half months. Hopefully, this will be finished next week. We wait.

DeleteCan someone help me understand how educated Americans/Europeans get stuck in this cult? I know some ex-devotees read this blog! I can totally understand why poorer Indians who lived in poverty prior to coming to Nithyananda's ashram will be ride or die for him even if they are being abused by him or witnessing abuse because they don't want to be tossed out on the street or poisoned...but these educated people from other countries with money/wealth or rich parents..what keeps them in a trance and loving their guru?
ReplyDeleteI've tried talking to a few young male devotees whom don't live at the ashram anymore and whom moved back to the USA. Some are dating a Indian female devotee from the cult..and the female devotees made them get credit cards I was told and they're paying all the bills. It seems as if the females in this cult have a trance power over the white male devotees and are causing them debt.

If someone is so-called 'out' of the cult, but still dating someone who is still 'in' the cult and supporting that person, then this person is still stuck 'in' the cult. The ties are not severed and support to help keep the cult going is there.
Nithyananda uses all kinds of ways to suck people into the cult. Sleep deprivation, credit-stealing for meditation techniques, cheap magic tricks, multi-tier marketing, identification theft (name changes), and dark siddhis masquerading as 'divine power'. For instance, the day that 'we' (first batch) of 'enlightened' suckers back in July 2007, we were buzzing with dizziness until the 'spell' wore off.
Nithyananda prays on educated people with little to no spiritual experience. These people are 'ripe' to fall into his cult trap. The economic situation is irrelevant. If anything, Nithyananda wants educated prospects to fall in his cult, so later they can be useful slaves toiling 20 hours a day all for his benefit.
Once in the cult trap, it is hard to crawl out. Logic and facts get drown. Other cult members are ready to pull anyone down again if they get the strength to question their predicament.
Anyone who tries to get out has others hounding them to get back in. Nithyananda will hold any information of wrongdoing that is achieved from confessions. Other fears, hopes, and weaknesses are exploited to the maximum. Some might call this blackmail. It's worse than trying to leave the mob.
Back to the people stuck with significant others still in. Yes, Nithyananda set his cult trap up like a big club. Every aspect of a cult member's life is reinforced with inserted points into someone's daily life and with the interaction from other cult members.
The only way to break the chain is to completely withdraw and break all aspects of the cult. A partial break will lead to being sucked back in again.
For instance, most of the original ashramites in Los Angeles, the same batch that became 'enlightened' along with us, most of them had to hide after the 2010 scandal in order to break from the cult. Others went 'dark' in fear of being sued or arrested, which is a true fear.
Take Mr. Srikrishna Challa, a.k.a. Sri Medananda Swami. He used to be the marketing face for Nithyananda and his cult. He was Nithyananda's top speaker. After the scandal broke in 2010, he withdrew from the cult, but still was 'forced' to file a lawsuit against us back in 2011. He was 'not active', but certainly not 'out'. Stuck. Now he hides his face in shame and has zero presence in LinkedIn or any other social media, much like a felon on the run. We know this as fact for the evil cult lawyer in L.A., Aviv L. Tuchman, was asking the plaintiffs who were suing the cult about Srikrishna Challa's whereabouts. The only way out for these cowards is to completely hide in shame.

DeleteI looked through some of p.s. dinesh Kumar’s cases on indiankanoon.org just to get a feeling. In most of the cases the public prosecutor agreed to the opposing party and so the judgement was straight forward or his judgements quoted clauses in the law that he based his judgement on. Since sh!tananda’s case is taking longer, I can only surmise that the public prosecutor did not accept the opposing lawyers arguments. Also, there’s nothing obvious in the law to speed a judgement. Of the cases regarding NBWs, he has quashed the NBW if the parties have agreed to appear in the lower court. Once again I can only surmise that the parties have not agreed to appear else it would have been closed by now. Of course it’s purely subjective but thought worth mentioning

DeleteThanks for the updates. Yes, a flurry of fundraising activity on Facebook. Although $42,000 USD seems like a lot of money, this amounts to less than three IA participants (assuming the rack rate of $15,000 USD per participant).
Besides the revenue from Google AdWords, there online boutique on Amazon.com, and for-spiritual-use-only herbs, that's it for the last six months.
There's a lot of open mouths at the ashram who all most be wondering on how to materialize their next chapati.
Perhaps Ma Yogini Ma Nithya Yogananda (the well-rounded lady known for spitting things out of her mouth) might be asked to materialize some ludo for the troops. Now, won't that be a miracle worth paying for?
Unless Nithyananda allocated a big trove of cash to keep his ashrams going, it must be slim pickings and $42,000 isn't going to pay all their bills, legal fees, and other expenses. That's an average of $7,000 per month since Nithyananda went wondering away, far far away.
We do feel sorry for the people who did donate. Their karma just keeps being piled on. Oh, well. A fool and his money.

It's court time again. Today, both the Ramanagara District Court (trial court) and the High Court of Karnataka (appeals) have hearings.
We expect that nothing will happen in the Ramanagara District Court. But, it will be interesting to see when it sets the next hearing date.
All the action is in the High Court of Karnataka where the five appeals are 'scheduled' to have their final arguments with orders set. It could take a while before all the orders are set.
The Court's cause list show the five appeals as no. 40 in Courthouse 'lucky' no. 13. Same judge. P.S. Dinesh Kumar.

Yes, that is true and correct. First, the Ramanagara District Court (the trial court) pushed the can down by only one week and set the next hearing date for next Thursday, 6 December 2018. That is good.
Now, the High Court of Karnataka. The good news is that the cult's attorney, CV Nagesh, is finally exhausted. He is like a Southern Senator doing a filibuster. A true windbag. All oral arguments are finally over.
We were concerned that Ranjitha's attorney would be successful in dragging out the hearings because her appeal was recently added to the existing five. Apparently, that attorney's ability to yakety-yak (by the hour) is limited. So, we escaped that potential delay.
So, all the attorneys are done talking. Now, we have the waiting game for the Court to issue its verdict.
Judge P.S. Dinesh Kumar just has to write up five orders, and we are on our way. But, this could take a while. Weeks. Months (if he's really slow are taken a large envelope). Since there are five appeals, he most likely will post all the orders at once. Hopefully, he already has a draft started and just needs to finalize it.
Most likely this judge knows that whatever which way he rules that his orders will be going straight to the Supreme Court on appeal. For this reason, he might be very cautious to ensure that his legal logic is correct with the right cases cited. More time. After all, no judge wants to look bad to Supreme Court.
So now we wait. Fingers crossed. The orders should fall in our favor, but the High Court of Karnataka hasn't always followed logic, the law, and common sense. Thankfully, the Supreme Court of India has.
Time will tell. Stay tuned.

If you remember the last high court appeal before charges were framed, hon judge Budihal took a few weeks in writing up the judgement. It went as logically expected, against the cult. Hope it’s quicker this time around. We will see. But the Supreme Court hearing the last time lasted a few minutes
